Refund & Returns Policy

Thank you for ordering from Avsome Inc. We want you to enjoy every order. This policy explains when we provide refunds or replacements, how to ask for one, and the few situations where we are not able to offer a refund. Please read it before you place your order - it is part of your purchase.

1. Our Commitment to You

Because we sell a packaged food and beverage product, your satisfaction and safety matter to us. If something is wrong with your order, we will make it right with a refund or a replacement, as explained below.

2. When We Will Refund or Replace Your Order

We will provide a refund or a replacement — your choice — if any of the following happens:

  • Your order arrives damaged, leaking, or broken.

  • A product is defective, spoiled, or unsafe to drink.

  • You received the wrong item or the wrong quantity.

  • Your order is significantly different from how it was described.

  • Your order never arrives or is lost in transit (see Section 4, Shipping & Delivery).

You do not need to ship the product back to us. Because our product is a beverage meant to be consumed, we may simply ask you to send a photo of the problem so we can confirm it and improve our packaging.

3. How to Request a Refund or Replacement

To request a refund or replacement, email us at [support@awesomeicetea.com] within 30 days of receiving your delivery. Please include:

  • Your order number;

  • A short description of the problem; and

  • A photo, if the product arrived damaged, leaking, defective, or spoiled.

We will respond as quickly as we can and let you know the next steps.

4. Shipping & Delivery

We work to ship every order as promptly as we can. We do not guarantee a specific delivery date. If for any reason we are unable to ship your order within 30 days after you place it, we will contact you. You can then choose to keep waiting for your order or cancel it for a full refund. If your order is confirmed lost in transit, we will refund or replace it.

5. When We Are Not Able to Offer a Refund

We are not able to offer refunds or replacements in these situations:

  • You changed your mind after the order shipped, or simply no longer want the product.

  • You did not care for the taste or flavor (taste is personal, and for food-safety reasons we cannot resell returned beverages).

  • The product was opened, used, or consumed — unless it was defective, spoiled, or unsafe.

  • You entered an incorrect shipping address and the order was delivered as addressed.

  • The product has passed the ‘best before’ or expiration date printed on the packaging, or was not stored as directed on the packaging — unless it was already defective, spoiled, or unsafe when it arrived.

6. How and When You Will Get Your Refund

Approved refunds are issued to your original payment method, usually within 7 business days after we approve your request. Depending on your bank or card issuer, it may take a few additional days for the refund to appear on your statement.

7. Product Warranties and Limitations

This section explains the warranties that apply to our products and the limits on our responsibility. Some of it appears in capital letters so that it clearly stands out, as the law requires.

Our products are perishable. They are guaranteed to be fit for consumption until the ‘best before’ or expiration date printed on the packaging, when stored as directed. We are not responsible for a product that has passed that date or that was not stored as directed, unless it was already defective, spoiled, or unsafe when it arrived.

OUR PRODUCTS ARE INTENDED FOR ORDINARY CONSUMPTION AS A PACKAGED BEVERAGE. EXCEPT AS EXPRESSLY STATED IN THIS POLICY, AND EXCEPT FOR ANY RIGHTS THAT CANNOT BE WAIVED OR LIMITED UNDER APPLICABLE LAW, AVESOME INC. SELLS ITS PRODUCTS WITHOUT IMPLIED WARRANTIES OF ANY KIND. AVESOME INC. SPECIFICALLY DISCLAIMS THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.

YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY PRODUCT THAT IS DEFECTIVE, DAMAGED, SPOILED, OR OTHERWISE NOT AS DESCRIBED IS A REFUND OR REPLACEMENT AS SET OUT IN THIS POLICY.

TO THE FULLEST EXTENT PERMITTED BY LAW, AVESOME INC. IS NOT RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. NOTHING IN THIS POLICY LIMITS OR EXCLUDES ANY LIABILITY THAT CANNOT BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR PERSONAL INJURY CAUSED BY A DEFECTIVE PRODUCT. THIS POLICY DOES NOT TAKE AWAY ANY RIGHTS YOU HAVE UNDER THE LAW OF YOUR STATE.

8. Additional Rights for Consumers in the European Union and EEA

If you are a consumer who lives in the European Union (EU) or European Economic Area (EEA), you have additional rights under EU law. These rights are given to you by law and cannot be taken away. Where anything in this Section 8 differs from the rest of this policy, this Section 8 applies to you and overrides the rest.

8.1 Your 14-Day Right to Cancel (Right of Withdrawal)

For most online purchases, EU/EEA consumers may cancel an order within 14 days of receiving the goods, without giving any reason. For health and hygiene reasons, this right does not apply to sealed food or beverage products once the seal has been opened. In practice:

  • If your product is still sealed and unopened, you may cancel within 14 days and return it for a full refund.

  • Once you open the seal, the 14-day cancellation right no longer applies - but your right to a refund or replacement for a faulty or non-conforming product (Section 8.3) always remains.

To cancel, tell us clearly within 14 days - for example, by email at [support@awesomeicetea.com], or by using the model form in Section 8.2. We will refund all payments we received from you, including standard delivery costs, within 14 days after you tell us. We may wait to refund until we have received the goods back or you have shown proof that you sent them. You are responsible for the cost of returning sealed, unopened goods unless we tell you otherwise.

8.3 Legal Guarantee – Faulty or Non-Conforming Products

Separately from the 14-day right above, EU/EEA consumers are entitled by law to a guarantee of at least two years that goods conform to the contract at the time of delivery. If a product is faulty, not as described, or otherwise does not conform, you are entitled to have it put right — normally a replacement — or to an appropriate price reduction or refund, at no cost to you. This legal guarantee applies regardless of Section 7 (Product Warranties and Limitations), which does not limit the rights of EU/EEA consumers.

Because our products are perishable food items, this guarantee reflects the durability that is normal for goods of this kind. Our products are guaranteed to remain fit for consumption until the ‘best before’ or expiration date printed on the packaging, provided they are stored as directed on the packaging. The two-year period is the time within which you may raise a lack of conformity that existed at delivery; it does not mean the product will remain drinkable for two years. Deterioration that appears after the printed date, or that results from storage other than as directed, is not a lack of conformity.

8.4 Unfair Terms

Nothing in this policy is intended to exclude or limit any right you have as an EU/EEA consumer that cannot be excluded or limited by law. Any term that would do so does not apply to you.

8.5 Complaints and Dispute Resolution

If you have a complaint, please contact us first at [support@awesomeicetea.com] and we will try to resolve it. Depending on where you live, you may also have the right to refer the dispute to an alternative dispute resolution (ADR) body in your country. (The European Union’s central Online Dispute Resolution platform was permanently discontinued on 20 July 2025 and is no longer available.)
